Welcome to linQsupply®. By accessing our platform and using our services, you agree to the following Terms of Use. These terms constitute a binding agreement between you and inSyca IT Solutions GmbH.
By using the platform or services, you confirm that you have read and fully agree to these Terms of Use. If you do not agree, you may not use the platform.

  • "Platform": The linQsupply® website and all associated services.
  • "User": Any individual or legal entity accessing or using the platform.
  • "Content": All information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials available on the platform.

Use of the Platform

Access Requirements

Our services are intended exclusively for business customers. By using the platform, you confirm that you are acting on behalf of a business entity.

Registration

To access certain features of the platform, you must create an account. By creating an account, you agree to these Terms of Use and confirm that you have acknowledged them.

User Responsibilities

  • The user is responsible for the security of their account and all activities that occur under their account.
  • The user agrees not to use the platform for any illegal or unauthorized purposes.
  • The customer ensures that all transmitted data is lawful, complete, and accurate.

Responsibilities and Roles

  • Customer's Role: The customer is responsible for the legality, accuracy, and completeness of the data transmitted through the platform. linQsupply® assumes no responsibility for errors or incomplete data provided by the customer.
  • Role of linQsupply®: linQsupply® acts as a technical service provider (data processor) and transmits data on behalf of the customer to their designated business partners. linQsupply® does not assume any content-related responsibility for the transmitted data.

Data Transmission and Liability

Availability and Reliability

linQsupply® strives to ensure high platform availability. However, we do not guarantee uninterrupted operation or error-free data transmission.

Limitation of Liability

linQsupply® is not liable for losses or damages resulting from delays, interruptions, or errors in data transmission unless caused by intentional or gross negligence.

Security Measures and Customer Obligations

Security Measures by linQsupply®

linQsupply® implements appropriate technical and organizational measures to protect the data during transmission and storage, including encryption and access controls.

Customer Security Obligations

The customer is responsible for securely managing their access credentials and preventing unauthorized access to their systems.

Compliance with Data Protection Laws

  • linQsupply® provides a Data Processing Agreement (DPA) to define the data protection obligations between the parties.
  • The customer is responsible for ensuring that the processing of transmitted data complies with applicable data protection laws, including obtaining necessary consents from affected individuals.

Interoperability and Integration

  • linQsupply® provides APIs and other integration options but assumes no responsibility for the compatibility of the platform with third-party systems used by the customer.
  • The integration of linQsupply® with ERP systems, accounting tools, or other software solutions is the responsibility of the customer or a third-party provider engaged by them.

Logging and Transaction Records

  • linQsupply® retains log and transaction records to analyze errors and ensure service quality.
  • Logs are stored for a period of 12 months and are then deleted or anonymized.

Rights to Data Deletion

  • Upon termination of the agreement, linQsupply® will delete the customer’s stored data within 30 days unless there is a legal obligation to retain it.
  • Upon request, the data can be returned to the customer for an additional fee.

Special Cases for International Data Transfers

The customer is responsible for ensuring that all international business partners to whom data is transmitted comply with applicable data protection regulations. linQsupply® will provide documentation to support compliance where necessary.

Changes to the Terms of Use

linQsupply® reserves the right to amend these Terms of Use at any time. Changes will be published on the platform. Your continued use of the platform after such changes constitutes your acceptance of the updated terms.

Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for all disputes arising from or related to these Terms of Use is the registered office of linQsupply®.
