Welcome to linQsupply®. By accessing our platform and using our services, you agree to the following Terms of Use. These terms constitute a binding agreement between you and inSyca IT Solutions GmbH.
 By using the platform or services, you confirm that you have read and fully agree to these Terms of Use. If you do not agree, you may not use the platform.

  • „Plattform“: Die linQsupply®-Website und alle damit verbundenen Dienste.
  • „Nutzer“: Jede natürliche oder juristische Person, die auf die Plattform zugreift oder sie nutzt.
  • „Inhalte“: Alle Informationen, Daten, Texte, Software, Musik, Töne, Fotografien, Grafiken, Videos, Nachrichten oder andere Materialien, die auf der Plattform verfügbar sind.

Use of the platform

Entry requirements

Our services are intended exclusively for business customers. By using the platform, you confirm that you are acting on behalf of a business entity.

Registration

To use certain features of the platform, you need to create an account. By creating an account, you agree to be bound by these Terms of Use and confirm that you have read them.

User responsibilities

  • The user is responsible for the security of their account and all activities that occur under their account.
  • The user undertakes not to use the platform for illegal or unauthorized purposes.
  • The customer ensures that all data submitted is lawful, complete and correct.

Responsibilities and roles

  • Role of the Customer: The customer is responsible for the legality, accuracy and completeness of the data they submit through the platform. linQsupply® assumes no responsibility for errors or incomplete data.
  • Role of linQsupply®: linQsupply® acts as a technical service provider (processor) and transmits data on behalf of the customer to its defined business partners. linQsupply® assumes no responsibility for the content of the transmitted data.

Data transfer and liability

Availability and reliability

linQsupply® strives to ensure high availability of the platform. However, no guarantee for uninterrupted operation or error-free data transmission is assumed.

Limitation

linQsupply® is not liable for any loss or damage caused by delays, interruptions or errors in the transmission of data, unless these are due to intent or gross negligence.

Security measures and obligations of the customer

Security requirements of linQsupply®

linQsupply® implements appropriate technical and organizational measures to ensure the security of data during transmission and storage. These include encryption and access controls, among other things.

Security requirements of the customer

The Customer undertakes to keep its access data secure and to prevent unauthorized access to its systems.

Privacy compliance

  • By using linQsupply®, the Customer agrees to be bound by the Privacy Policy for linQsupply® provided on the Website as well as the Third-Party Sub-processors for linQsupply® . These documents govern the data protection obligations between the parties, as well as the processing of personal data by third parties.
  • The customer is obliged to ensure that the processing of the data transmitted via linQsupply® complies with the applicable data protection regulations. This includes, in particular, obtaining the necessary consents from data subjects and ensuring lawful data processing in accordance with the General Data Protection Regulation (GDPR).

Interoperability and integration

  • linQsupply® provides APIs and other integration capabilities but assumes no responsibility for the compatibility of the platform with third-party systems used by the customer.
  • The integration of linQsupply® with ERP systems, accounting tools or other software solutions is the responsibility of the customer or a contracted third-party provider.

Logging and transmission logs

  • linQsupply® stores log data and transmission logs to analyze errors and ensure quality of service.
  • Log data is stored for a period of 12 months and then deleted or anonymized.

Rights to data deletion

  • After termination of the contractual relationship, linQsupply® will delete the customer's stored data within 30 days, unless there is a legal obligation to retain it.
  • On request, the data can be transferred to the customer for an additional fee.

Special cases in international data traffic

The Customer shall ensure that all international business partners to whom data is transferred comply with the relevant data protection regulations. linQsupply® supports with documentation if required to ensure compliance.

Changes to the Terms of Use

linQsupply® reserves the right to change these Terms of Use at any time. Changes will be published on the platform. Your continued use of the platform after any such changes will be deemed acceptance of the amended Terms.

Governing law and jurisdiction

These Terms of Use are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms of Use is the registered office of inSyca IT Solutions GmbH.
